General conditions of sale for purchases on the website www.arredindustria-shop.it

The company Arredindustria e Lory Srl, registered office in Via delle bazzone, 4 23851 Galbiate (LC), registered in the business register number LC-227876, VAT number 01940010133, carries out, through the website www.arredindustria-shop.it of which it is the owner , the sale of products and/or compositions of products via internet. The conditions of sale described below apply in compliance with the rules on electronic commerce (law decree n. 70/2003).

GENERAL CONDITIONS OF SALE

These conditions are an integral and essential part of the purchase contract for any product on the site.

Sending an order implies acceptance by the customer of the general conditions of sale in place.

Arredindustria e Lory Srl reserves the right to revise these conditions at any time without notice.

CONTRACT

If you wish to purchase one or more products on the site, you can add them to your cart. Once all the items and relative quantities that you intend to purchase have been selected, you can enter the data necessary for billing and the delivery address. Before proceeding to the check-out, a summary page will appear with the billing and delivery data of the selected products, their price and the shipping cost, at this point it will be possible to choose the payment method. Your order will therefore be considered as your contractual purchase proposal addressed to Arredindustria for the products listed. Upon receipt of your order, an automatic responder will send an order receipt e-mail called “Order Confirmation” which does not yet constitute acceptance of your purchase proposal. The sales contract with Arredindustria will only end when we send you an e-mail accepting your purchase proposal which will contain:

– Invoice in electronic format for your advance payment

– information relating to the shipment of the product and the expected date of delivery.

Online purchases on the website www.arredindustria-shop.it can only be made with the advance payment method by credit card or bank transfer.

PURCHASE WITH PAYMENT BY CREDIT CARD

Your purchase proposal will be considered valid upon receipt of payment by Arredindustria by e-mail, it will send the customer confirmation of receipt of your order containing the salient summary data (order number, code and quantity of products purchased, amount of the goods purchased, amount of shipping costs, amount of VAT) and notification of receipt of payment. In the following 24/48 hours Arredindustria will send acceptance of your purchase order and regular invoice in electronic format for the amount paid. If, on the other hand, Arredindustria cannot accept your order due to (by way of example but not limited to) unavailability of the product and/or incorrect allocation of the price, it will refund the amount paid via the Paypal platform.

PURCHASE WITH PAYMENT BY BANK TRANSFER.

Arredindustria by e-mail will send the customer the confirmation of receipt of the order containing the salient summary data (order number, code and quantity of products purchased, amount of goods purchased, amount of shipping costs, amount of VAT) and bank details to carry out the wire transfer. Your purchase proposal will be considered valid upon receipt of payment to Arredindustria. In the following 24/48 hours Arredindustria will send acceptance of your purchase order and regular invoice in electronic format for the amount paid. If, on the other hand, Arredindustria cannot accept your order due to (indicative but not exhaustive) unavailability of the product and/or incorrect allocation of the price, it will refund the amount paid by bank transfer.

RIGHT OF WITHDRAWAL

Pursuant to the European Directive 2011/83, implemented in Italy with the Legislative Decree of 3 December 2013, the buyer may withdraw from the sales contract without necessarily specifying the reason for the return. The customer wishing to exercise the right of withdrawal must communicate his will to Arredindustria by registered letter with acknowledgment of receipt (to be sent to Arredindustria-Via delle bazzone, 4-23851 Galbiate-LC). The return shipping costs are fully charged to the customer. Arredindustria will proceed with the refund by bank transfer no later than 30 days from the communication of the right of withdrawal, only and exclusively after a careful check of the condition of the goods the right of withdrawal is lost if the returned product is not intact, or lacks the original packaging external and internal, is damaged or even partially used.

The return costs and any redelivery costs are totally borne by Arredindustria only and exclusively if the goods are damaged during opening and if the buyer has objected to checking the delivery receipt.

RETURNS

Returns of goods will not be accepted unless previously claimed by written communication to Arredindustria and subsequently authorized by it, always by written communication. In the absence of authorization for the return, the goods, even if received at the Arredindustria warehouse, will remain at the disposal of the buyer and the latter will remain subject to the obligation to pay the price, as well as the storage charges, to the extent of 0.2% per day on the taxable value of the goods. Returns must therefore be accompanied by the relevant return authorization document, and carried out at the buyer’s expense and risk. The goods, subject to authorization, must be sent to the warehouse located in Via delle Bazzone, 4 Galbiate (LC). If the goods are damaged due to lack of the original packaging, Arredindustria will have the right to charge the buyer for the repair costs or not to accept the return. Any substitutions can only take place with identical products, or, at Arredindustria’s discretion, with others of equivalent or higher value, upon payment of the relative difference by the customer.

PRICES

All prices quoted in the product sheets are excluding VAT and shipping costs. On the website www.arredindustria-shop.it the VAT and shipping costs are clearly indicated both in the shopping cart form and in the purchase order form.

DELIVERY TIME

At the same time as the order is accepted, the estimated delivery date will be indicated to the customer. This date has an exclusively indicative value, therefore the Arredindustria company will not be liable for any damage caused by deliveries made after the indicated date. Subsequently, the Customer will be contacted directly by the Carrier (national courier) to agree on the time slot and the day on which the Delivery will be made.

The term “shipping times” means the time in which the goods are entrusted to the courier.

The term “delivery times” means the time needed to send the product from our warehouses to its destination. Shipping and delivery times are absolutely indicative and may vary according to the type and availability of the product, the low or high season, according to the holiday periods and/or according to the delivery area. Any delays following the assignment of the goods to the courier cannot be grounds for complaint for Arredindustria.

What reservations must the customer place on the waybill issued by the courier?

Even before examining the package, the customer must pay close attention to the delivery maneuver of the person in charge.

The customer must accept RESERVE FOR IMPROPER HANDLING if the shipper pays little attention in unloading the goods, check that our label applied to the package correctly shows the delivery details (shipping address). In the event of an error, he will have to reject the shipment, highlighting to the carrier the discrepancy between the addresses on the package and on the shipping note. It will be up to the shipper to trace the correct package in its distribution network and deliver it to you after a few days.

The customer must then verify that the seals and/or warranty labels present are perfectly intact and not covered with the courier’s adhesive tape. Otherwise, the customer must accept RESERVE FOR SUSPECTED TAMPERING.

On the other hand, the customer must accept RESERVE FOR VISUALLY DAMAGED NECK if he finds a slightest anomaly and specify in detail the extent of the damage (if the package is wet, bent…). In the event that the forwarder opposes it, it is advisable not to sign the courier note and to promptly contact our customer service on 0341 240314. Our logistics department will start the investigation. The shipper will be liable for damages caused during transport.

Signing without reserve or with reserve without giving reasons does not count for the purposes of the dispute and is equivalent to not making reservations. To open an insurance case it is MANDATORY to affix a non-generic but well-motivated control reserve. Under no circumstances should unsubstantiated reserve terms be affixed: write, for example, “ACCEPTED SUBJECT TO VERIFICATION” or “SUBJECT TO CONTROL” exempting Arredindustria from any liability. The customer will not have to worry about any reservations presented to the shipper; these will be automatically canceled after 8 days.

What happens if the buyer refuses delivery?

If the buyer refuses the goods, they will be delivered to the courier’s warehouse closest to the customer. The courier will send the notice of stock directly to Arredindustria.

If the buyer refuses the goods because they are visually damaged, the return costs and any storage and delivery costs are totally borne by the Arredindustria company;

If the buyer refuses the goods without a valid reason, the return costs and any storage and delivery costs are totally charged to the customer.

WARRANTY

The Customer has the right to make use of the legal guarantee provided for in the Civil Code. This Guarantee provides, among other things, that the non-Consumer Customer, under penalty of forfeiture, notifies the Arredindustria company in writing of any lack of conformity found in the product purchased within 8 (eight) days of discovery by registered letter with return receipt.

Transfer of risk – art.63 Consumer Code:

1. In contracts which place the obligation on the professional to arrange for the shipment of the goods, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated by him and different from the carrier, materially takes possession of the goods.

2. However, the risk is transferred to the consumer as soon as the goods are delivered to the carrier if the latter has been chosen by the consumer and this choice has not been proposed by the trader, without prejudice to the rights of the consumer against the carrier.

JURISDICTION

Jurisdiction.

For any dispute concerning the interpretation, application and execution of this contract, the parties declare that the competent court will be that of Lecco with the exclusion of any other competing court.

In the case of a private Customer, the Court of residence of the Customer will have exclusive jurisdiction in relation to any dispute deriving from or relating to these conditions.

Applicable law.

The parties declare that the law applicable to this contract will be exclusively the Italian one.
